A 38-year-old DeLand man has been arrested after he hit another motorist with his vehicle.
Brien Macnicol (DOB: 1-17-1983) was arrested and charged Monday with aggravated battery and taken to the Volusia County Branch Jail. He has since been released after posting $5,000 bail.
Police responded at 9 p.m. Monday to the intersection of Orange Camp Road and South Woodland Boulevard after a motorist called authorities claiming he had been hit by a white PT Cruiser, later determined to have been driven by Macnicol. The victim told officers that he had been cut off by the PT Cruiser, forcing him to take evasive action in which he almost hit an object near the road. The victim said he followed Macnicol's vehicle until they came to a stop at the intersection at Orange Camp and South Woodland Boulevard.
The victim said he got out of his vehicle and walked in front of the PT Cruiser in an attempt to get Macnicol to pull over. The victim and nearby witnesses said Macnicol backed up his vehicle in order to speed up and hit the victim before driving away. The victim suffered non life-threatening injuries and declined medical treatment.
As officers were investigating the incident, they were alerted that a man identifying himself as Brien Macnicol had contacted dispatch to report that another vehicle was following him after he had accidentally cut them off. Macnicol said when they stopped at the intersection the driver of the other vehicle tried to "box him in" at the light. Macnicol told dispatch he drove away and was not sure if he hit the other driver.
Macnicol pulled into a parking lot at a nearby business and waited for law enforcement to arrive before being arrested.
