Arrest made in Overdose
Overdose Death 07/16/2020 – Comfort Inn 400 E International Speedway Blvd
On July 16th 2020 DeLand PD Officers responded to the Comfort Inn, located at 400 E International Speedway Blvd, in reference to a CPR in progress. DPD Units were directed to room #206, where 33-year-old male was declared deceased by the paramedics on scene. A DeLand PD Special Investigations Unit Detective responded to the scene, and contacted Hiram Oyola, who was in the hotel room with the victim during the incident. Through ensuing investigation, it was determined that Oyola had sold Oxycodone to the victim on the date of his death, and was present when the victim ingested said narcotics.
On August 18th 2020, Detectives reviewed the Autopsy report from the Volusia County Medical Examiners Office, which determined the cause of death to be a combination of Oxycodone and Fentanyl Toxicity. Under Florida Statute 782.04(4)(l), the following justifies the charge of 2nd Degree Murder: Unlawful distribution of any substance controlled under F.S. 893.03(1), cocaine as described in F.S. 893.03(2)(a)4., or opium or any synthetic or natural salt, compound, derivative, or preparation of opium by a person 18 years of age or older, when such drug is proven to be the proximate cause of the death of the user.
On September 2nd DeLand PD Special Investigations Unit obtained an arrest warrant for Hiram Oyola for the following charges: 2nd Degree Murder, Unlawful Use of a Two-Way Communication Device to Commit a Felony, Sale and Delivery of Oxycodone, and Possession of Narcotics Paraphernalia.
Hiram Oyola turned himself in at the Volusia County Branch Jail on 09/09/2020, where he is currently being held without bond.
